The Apes vs Mutants and Mutants vs Apes Mobile Game Competitions (“Con-
test”) are open only to natural persons who are at least eighteen (18) years
LAW. Contest may only be entered from and in eligible jurisdictions. Sponsor,
its parent, subsidiary and affiliate companies, employees, agents and suppli-
ers, and the immediate family (spouse, parents, siblings and children) and
household members of each such person are not eligible to participate or win
any Prize. Sponsor may request any potential Prize winner to provide proof
that such person is the winner. All potential winners are subject to verification
by Sponsor before any Prize will be awarded.

Any person who enters the contest (“Entrant”) fully and unconditionally
agrees and accepts these Official Rules and Sponsor’s decisions, which are fi-
nal and binding in all matters related to the Contest. Winning a Prize is con-
tingent upon fulfilling all requirements set forth herein.

The Sponsor of the Contest is Yuga Labs, LLC (“Sponsor”).

The Contest period begins at 7:00pm Eastern Time (“ET”) on January 21,
2022 and ends at 7pm ET on January 28, 2022 (“Contest Period”). Sponsor’s
computer is the official time keeping device of the Contest.


Registration Required
The Contest is open only to legal and legitimate Bored Ape Yacht Club (BAYC)
and Mutant Ape Yacht Club (MAYC) members only. Here’s how you register:
Users who own an Ape and/or Mutant are required to retrieve a one-time use
passcode that will enable them to register for the game. To retrieve this pass-
code, users can go to, and
connect their MetaMask wallet containing their Ape and/or Mutant. Users then
enter their passcodes in order to access the appropriate registration form lo-
cated at the following: (Apes:, Mutants: https:// Here, users who wish to be eligible for a prize enter

their personal information (including name, email address and physical ad-
dress). Finally, users download the game from the iOS app store or Google
Play store (or download the Android APK) and create an account for the game
using the same email address that they used to register in the previous step.

How to Compete
To compete, users play the game - either as an ape or a mutant - through a
room shooting characters with bananas. The cumulative score over the
course of the contest determines who wins. Entrants will have an unlimited
number of plays for the duration of the seven day Contest period. Entrants
will play individually through challenges in the game, completing levels and
accumulating points. Point totals are displayed on a leaderboard from which
top players will be selected.

Winner Selection
Winners will be qualified by scoring through gameplay. Scores will be re-
flected on a leaderboard for each game respectively. Top winners, as detailed
in “Prizes”, will be awarded in each category. Only registered and qualified
players will be eligible to win. Winners will be selected no later than February
4, 2022 based on their rank on the leaderboard. Winners will be notified by
the email they provided upon registration. First Place winner of the 2002
Honda Accord will be required to sign and return an Affidavit of Eligibility and
Liability Release prior to accepting delivery.

Each Entrant is eligible to receive up to one Prize from each category (First
Place, Top 50, Top 100, Top 250, Top 500) during the Contest Period. Prizes
consist of:

All prizes are awarded as is. Sponsor is not required to award elsewhere any
prizes forfeited by the chosen winner. Sponsor is not responsible for any late,
lost, stolen, damaged, delayed, or undelivered prizes. Sponsor notes that
some prizes may take several months to ship due to ongoing worldwide sup-
ply chain issues.

Multiple entrants are not permitted to share the same email address or other
relevant accounts. Use of any repetitive, automatic, programmed or similar
technology, system or agent (including without limitation Contest entry ser-
vices) to enter is prohibited and will void all Prizes by that Entrant. Any auto-
mated receipt (such as one confirming e-mail) does not constitute proof of
actual receipt by Sponsor of an entry. The Sponsor is not responsible for lost,
late, incomplete, invalid, unintelligible or misdirected Prizes, which will be dis-

Sponsor. Prizes are non-transferable, and no substitution will be made except
as provided herein at the Sponsor’s sole discretion. Winners are responsible

Except where prohibited by applicable law, participation in the Contest con-
stitutes Entrant’s consent for Sponsor to use Entrant’s name, image, likeness,

voice, opinions, and other user content for any and all purposes in any media,

worldwide, without further payment or consideration.

Entrants may withdraw personal data upon request. Information submitted by
Entrants is subject to Sponsor’s privacy policy. Entrant’s participation in this
Contest constitutes consent for Sponsor to use Entrant’s personal information
solely for the purpose of administering the Contest and awarding the Prizes,
unless Entrant has opted to receive e-mail communications from Sponsor. En-
trants’ information will be processed in accordance with Sponsor’s privacy

In the event that the operation, security, or administration of the Contest is
impaired in any way for any reason, including without limitation, fraud, virus
or other technical problem, Sponsor may, in its sole discretion, either: (a) sus-
pend the Contest to address the impairment and then resume the Contest in
a manner that best conforms to the spirit of these Official Rules; or (b) cancel
or terminate the Contest. Sponsor reserves the right in its sole discretion to
disqualify any individual it finds to be tampering with the entry process or the
operation of the Contest or to be acting in violation of the Official Rules of this
or any other Contest, or in an unsportsmanlike or disruptive manner. Any at-
tempt by any person to undermine the legitimate operation of the Contest
may be a violation of criminal and civil law, and, should such an attempt be
made, Sponsor reserves the right to seek damages from any such person to
the fullest extent permitted by law. Sponsor’s failure to enforce any provision
of these Official Rules shall not constitute a waiver of that provision.

Except where prohibited, by participating in the Contest, Entrant releases
Sponsor, promotional agencies, and each of their respective parent compa-
nies, affiliates, subsidiaries, successors, assigns, contractors, agents, repre-
sentatives, officers, directors, shareholders, and employees, (collectively “Re-
leased Parties”), from and against any and all liability for any claims, costs,
injuries, losses or damages of any kind arising in connection with the Contest,
including without limitation (a) the unauthorized or illegal access to person-
ally identifiable or sensitive information; (b) acceptance, possession, use,
misuse, or nonuse of the Prize that may be awarded; (c) any incorrect or inac-
curate information, whether caused by Entrants, printing errors or by any of
the equipment or programming associated with or utilized in the Contest; (d)
technical and/or communications malfunctions, errors or failures of any kind;
(e) unauthorized human intervention in any part of the Contest; (f) technical
or human error which may occur in the administration of the Contest or the
processing of entries; (g) any injury or damage to persons or property which
may be caused, directly or indirectly, in whole or in part, from Entrant’s par-
ticipation in the Contest or receipt or use or misuse of any Prize; (h) if Spon-
sor must cancel or terminate the Contest for any reason; or (i) if any Prize
cannot be awarded due to circumstances beyond Sponsor’s control. In no

event shall the Released Parties be liable for attorneys’ fees or other legal or

enforcement costs.

Entrant acknowledges that the Sponsor has neither made nor is in any man-
ner responsible or liable for any representation, warranty or guarantee, ex-
pressed or implied, in fact or in law, relative to a Prize including, without limi-
tation, the Prize quality or availability.

Winner of the First Place 2002 Honda Accord will be required to sign a release
of liability prior to being awarded the First Place Prize.

Sponsor reserves the right to cancel or modify the Contest if fraud, miscon-
duct or technical failures threaten the integrity of the Contest; or if a com-
puter virus, bug, or other technical problem corrupts the administration or se-
curity of the Contest as determined by Sponsor; or any other reason in Spon-
sor’s sole discretion requires modification or cancellation of the Contest. Ex-
ercise of this right to cancel or modify is in Sponsor’s sole discretion.

As a condition of participating in the Contest, Entrant agrees that any and all
disputes, claims and causes of action arising out of or in connection with this
Contest shall be resolved individually, without resort to any form of class ac-
tion, exclusively by mandatory, binding arbitration by the American Arbitra-
tion Association (“AAA”).

Entrant further agrees that under no circumstances will Entrant be permitted
to obtain awards for, and Entrant hereby waives all rights to claim any dam-
ages whatsoever including, without limitation, punitive, consequential, direct
or indirect, or any other damages. Sponsor reserves the right to modify Prize
award procedures. All issues and questions concerning the validity, construc-
tion, interpretation, performance, and enforcement of the Contest and these
Official Rules, or the rights and obligations of the Entrant and Sponsor, shall
be governed by and construed in accordance with the laws of Florida, without
giving effect to any choice of law or conflict of law rules, which would cause
the application of the laws of any jurisdiction other than Florida.
